Motor Vehicle Accidents

According to the National Highway Traffic Safety Administration (NHTSA.gov), there were 30,797 motor-vehicle accidents that resulted in fatalities – and this is only for accidents that occurred on public roadways. Fatalities from motor vehicle traffic accidents in New York state alone were responsible for 1,156 deaths. Counties within the 518 area code were responsible for 176.83 of those traffic fatalities. These counties include: Albany, Clinton, Columbia, Dutchess, Essex, Franklin, fulton, Greene, Hamilton, Montgomery, Rensselaer, St. Lawrence, Saratoga, Schenectady, Schoharie, Warren, and Washington. The chart below provides more detailed information describing when alcohol, speeding, and other factors were involved.

What these statistics do not include is how many accidents occurred where the drivers or nearby pedestrians were injured and not killed. It is estimated that a motor vehicle accident occurs in the United States every few seconds, leading to millions of injuries and insurance claims. If you have been involved in a car, truck, bus, tractor-trailor / semi-truck, motorcycle, CDTA, snow plow, or other motor vehicle accident and suffered injuries, contact our office to discuss the details of your case before you do anything. Our experience dealing with insurance companies and knowledge of the law can make all the difference in determining whether you may be compensated for lost wages, pain and suffering, medical bills, etc.

Products Liability

For the past 4 decades, products liability claims have dominated U.S. tort cases, with asbestos cases playing the largest role (source).  In 2002/2003, the Bureau of Justice Statistics estimated that 84% of Plaintiff winners in Federal tort cases received a median award of $201,000.  Of the tens of thousands of products liability claims that are initiated each year, many are settled outside of court with an agreement between the injured party and insurance company. Serious physical injuries and even death can occur from products that we use and that surround us every day, including: Carbon monoxide detectors, smoke detectors, beauty products & cosmetics, sporting equipments, hazardous materials, construction sites and equipment, vehicle recalls, silica, asbestos, prescription medication and other drugs, children’s toys, electronics including laptop batteries and other computer equipment, clothing, vioxx, outdoor equipment, etc. If you have a questions about a faulty or bad product that may have caused an injury you or a loved one suffered in the 518 area, please call our office for a free consultation of your case.

Malpractice

The Bureau of Justice Statistics found that in 2005, awards for jury trial Medical Malpractice cases were 17 times higher than other tort jury trial cases.  This was attributed to the fact that many of these cases included wrongful death accusations. And, in fact, the majority of medical malpractice cases in state from the year 2000 to 2004 closed without any compensation payments awarded. Types of medical malpractice claims include birth injuries (injury to a child or mother during the birthing process), failure to diagnose, medication errors like wrong prescription, nursing home abuse and neglect, hospital abuse and neglect, etc.

Medical malpractice cases are not the only types of malpractice personal injury cases that exist, although they do tend to be the most well-known, but Legal and Professional malpractice also exist. Legal malpractice claims may include: Conflicts of interest, poorly written legal documents, excessive litigation at the client’s expense, bad legal advice, dishonesty, errors and omissions that result in the dismissal of a case, obstructing justice, missing statutes of limitations deadlines, etc. Other professional malpractice claims include: misleading statements, insider trading, unauthorized transactions, billing fraud, negligence, gross negligence, misreporting facts, etc. To discuss the details of your 518 malpractice case with an attorney, please contact us by phone or email.

In addition to motor vehicle accidents, bad or faulty products, and malpractice, there are many other circumstances under which you or someone you love may have suffered a serious or debilitating injury, or even death. If you have been the victim of an accident where you have suffered some kind of injury like: a flesh wound resulting in a scar, broken bone, compact fracture, head trauma, brain damage, etc., you may be entitled to recover money for lost wages, pain & suffering, and more.
